Once the Copyright application is filed, the Copyright office issues a dairy number and issues a filing receipt to the applicant, thereafter, the application is formerly examined by the Copyright Examiner. Once the application found to be in order, the Registrar may accept the application and issue the Certificate of Registration.
If the examiner finds any defects in the application, he may communicate the same to the applicant. The examiner may object the Copyright application based on the third party complaint on issues related to originality, ownership, infringement, license and other reasons and the examiner issues the letters to the applicant and other parties associated.
Once the examiner issues objection letter, the applicant has to submit the reply within 30 days of the date of issue of the objection letter otherwise, the Copyright registrar may cancel the application and mark it as “Rejected” in the Copyright Journal.
If the registrar satisfies with the reply, he may accept it and issue the certificate of registration. If the registrar is not satisfied with the applicant’s reply to the examination report, he may give the last opportunity in the form of hearing and sends a hearing notice to the applicant and other parties if any connected.
Further, if the examiner satisfies with hearing, he may accept it and issue a Certificate of Registration otherwise, he will reject the application.
